INDEMNIFICATION

You agree to defend, indemnify and hold Jonathan Adler Enterprises LLC harmless from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the site.

WARRANTY DISCLAIMER:

No warranty is valid or provided against normal wear and tear, damage from improper use, accidents, abuse, neglect, improper storage, or damage or appearance changes resulting from improper care or storage. Because certain items may include components that are be hand-crafted and made with natural materials, variations in size, shape and color can be expected. 

JONATHAN ADLER LIMITATIONS AND COVERAGE EXCLUSIONS:

Implied Warranties: Jonathan Adler makes no implied warranties of merchantability or fitness for a particular purpose. These and all other implied warranties are specifically disclaimed. By implied warranties, Jonathan Adler references warranties that the law sometimes implies to have been given by the seller, even though they are not documented in writing. (Some states do not allow an exclusion or limitation on the length of an implied warranty, so the above exclusions/limitations may not apply to you.) Because the craftsmanship involved and the natural materials used in the manufacturing process, minor variations will occur from piece to piece. Therefore, this warranty does not cover such minor differences or and differences between floor samples or printed literature and the furniture that is delivered. This warranty and remedies set forth above are exclusive and in lieu of all others, oral or written, expressed or implied. In no event will Jonathan Adler be liable to you for any damages, including incidental or consequential damages, arising out of the use or inability to use this product.

Place of Purchase: This warranty protects Jonathan Adler purchases from Authorized Jonathan Adler Retailers only.

Household Use: This warranty applies only when you have purchased Jonathan Adler furniture and other products for your own normal household use, and not for resale or commercial use, which includes rental, business and institutional or other non-residential use.

Proper Care and Use: Proper care and usage are essential to preserving your rights under this warranty. This warranty does not apply if your Jonathan Adler merchandise is damaged by the use of detergents, abrasives or other harsh cleaning agents.

Accidents, Abuse and Normal Wear & Tear: This warranty does not cover damage resulting from negligence, abuse, normal wear and tear, or accidents: including (but not limited to) burns, cuts, scratches, tears, scuffs, watermarks, indentations or pet damage.

Product Modifications: Any product modification by retailer, consumer or other parties not authorized by Jonathan Adler will void this warranty.

Floor Samples, Warehouse Sale items, or As-Is Purchases: This warranty does not cover floor samples, items purchased at a Warehouse Sale, or products designated “as is” at time of purchase.

Consequential or Incidental Damages: Jonathan Adler will not be liable for any loss, expense or damage other than to the furniture or other Jonathan Adler product itself that may result from a defect in the furniture; we are not liable for any consequential or incidential damages. (Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations/exclusions may not apply to you.)

Your Warranty Rights: This warranty gives you specific legal rights and you may also have other rights, which vary from state to state. Except for such other rights, the remedies provided under this warranty state the limit of the responsibilities of Jonathan Adler.

OUR PROMISE: Within the provisions, time allowances and limitations of this warranty, we promise to repair or replace, or provide a refund for, at our option, any part or parts we deem to have.

MOBILE TERMS & CONDITIONS

Jonathan Adler offers its customers mobile alerts regarding sales, promotions, events, and cart reminders by SMS message (the "Service") on 65602. By participating in the Service, you are agreeing to these Terms and to the Privacy Policy.

Signing Up and Opting-In to the Service 
Enrollment in the Service requires you to provide your mobile phone number and to agree to these terms and conditions. You may not enroll if you are under 18 years old. Before the Service will start, you will need to agree to these Terms. Jonathan Adler reserves the right to stop offering the Service at any time with or without notice.

By opting into the Service, you:

A. Authorize Jonathan Adler to use auto dialer or non-auto dialed technology to send recurring text messages to the mobile phone number associated with your opt-in (i.e., the number listed on the opt-in form or, if none, the number from which you send the opt-in, or, if none, the number on file for the account associated with your opt-in).
B. Acknowledge that you do not have to agree to receive messages as a condition of purchase.
C. Confirm that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and that you are authorized to opt in.
D. Consent to the use of an electronic record to document your opt-in. To request a free paper or email copy of the opt-in or to update our records with your contact information, please call 800-963-0891. To view and retain an electronic copy of these Terms or the rest of your opt-in, you will need (i) a device (such as a computer or mobile phone) with Internet access, and (ii) and either a printer or storage space on such device. For an email copy, you'll also need an email account you can access from the device, along with a browser or other software that can display the emails. 

Content You May Receive 

Once you affirm your choice to opt-in to the Service on 65602, your message frequency may vary. You may receive alerts about:

A. Sale promotions
B. Event information
C. Product launch announcements
D. Cart reminders 

Charges and Carriers  

Message and data rates may apply. Please consult your service agreement with your wireless carrier or contact your wireless carrier to determine your phone's pricing plan and the charges for sending and receiving text messages. You acknowledge that you are responsible for any message, data or other charges incurred (usage, subscription, etc.) as a result of using the Service. 

Supported carriers are AT & T, T-Mobile, Verizon Wireless, Sprint, Boost, Virgin Mobile, U.S. Cellular, Cricket, Alltel, Cincinnati Bell, Cellcom, C-Spire, nTelos, MetroPCS, and other smaller regional carriers. The Service may not be available on all wireless carriers. Jonathan Adler may add or remove any wireless carrier from the Service at any time without notice. Jonathan Adler and mobile carriers are not responsible for any undue delays, failure of delivery, or errors in messages. 

To Stop the Service 

To stop receiving text messages from Jonathan Adler, text the word STOP to 65602 any time or reply STOP to any of the text messages you have received from Jonathan Adler. After texting STOP to 65602, you will receive one additional message confirming that your request has been processed.
